01Agreement to these terms

By using this website you accept these terms. If you do not accept them, please do not use the site. We may update these terms from time to time; the version published here is the one that applies, and the date at the top tells you when it last changed.

02What this website is

This website describes what TriNAG Technology Solutions does and how to reach us. The material on it is general information about our work. It is not an offer capable of acceptance, not a quotation, and not professional, legal, financial or compliance advice. Do not act on it without taking advice appropriate to your own circumstances.

Any work we do for you is governed by a separate written engagement agreement, including its own terms on scope, fees, confidentiality, intellectual property, data protection and liability. Where that agreement and this page differ, that agreement governs.

03Acceptable use

You agree not to:

• use the site for any unlawful purpose, or in breach of any applicable regulation;
• attempt to gain unauthorised access to the site, its server, or any connected system;
• probe, scan or test the vulnerability of the site, or breach its security measures, without our prior written permission;
• introduce malicious code, or interfere with the proper working of the site;
• scrape, harvest or systematically extract content, or use automated means to place unreasonable load on the site;
• misrepresent your identity or affiliation, or submit false information through any form on the site.

If you are a security researcher and you believe you have found a vulnerability, we would rather hear from you than not: write to it@trinagit.com with the details, and give us reasonable time to fix it before disclosing it publicly.

04Intellectual property

The content of this website — including its text, layout, design, graphics, code, and the TriNAG name and logo — is owned by us or licensed to us, and is protected by copyright and trade mark law. You may view it, and print or download extracts for your own reference or to evaluate working with us. You may not republish it, sell it, or use it commercially without our written permission.

Client names, logos and product screenshots shown on this site remain the property of those clients and appear with their permission. Nothing here grants you any right to use them.

05Links to other sites

This site links to systems operated by other organisations, including client platforms. We do not control them, we are not responsible for their content or their handling of your information, and a link is not an endorsement. Their terms and privacy policies apply once you leave this site.

06Availability

We aim to keep the site available, but we do not guarantee it will be uninterrupted or error-free. We may change, suspend or withdraw any part of it, at any time, without notice. Some features depend on third-party services; when one of those is unavailable, the corresponding feature falls back to static content or is temporarily unavailable.

07Disclaimer

The website and its content are provided "as is" and "as available". To the fullest extent permitted by law, we exclude all representations, warranties and conditions, whether express or implied, including as to accuracy, completeness, fitness for a particular purpose, and non-infringement. We do not warrant that the information on the site is current or complete, and we may change it at any time.

08Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, business, goodwill or data, arising out of your use of this website. Our total liability arising out of or in connection with this website, on any basis, is limited to CAD $100.

Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded. This clause does not apply to work performed under a signed engagement agreement, which carries its own liability terms.

09Indemnity

You agree to indemnify us against any claim, loss or expense arising from your breach of these terms or your misuse of the site.

10Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have exclusive jurisdiction over any dispute arising from them, and you submit to that jurisdiction. If any provision of these terms is found unenforceable, the rest continues to apply.
